– Because it is directly related to the establishment or performance of a contract, strictly necessary cookies are used to provide the services of the Platform.

WHO DO WE SHARE YOUR PERSONALLY IDENTIFIABLE DATA WITH AND FOR WHAT PURPOSES?

Our Company processes your personal data in accordance with the “need‑to‑know” and “need‑to‑use” principles, ensures data minimisation and takes necessary technical and administrative safeguards. HOW DOES THE COMPANY PROTECT YOUR PERSONAL DATA?

The personal data you provide to the Company is under the control and supervision of the Company. As the data controller, the Company undertakes its responsibility to organise and implement the necessary technical measures in accordance with applicable legislation for the confidentiality, integrity and protection of your information. In this respect:

– Penetration tests are carried out periodically in accordance with international and national technical standards.

– The Website, mobile site and mobile app transmit the personal data you send via SSL (Secure Sockets Layer) technology.

– Risk analyses are carried out regularly and necessary actions are taken to mitigate risks.

YOUR RIGHTS AND REQUESTS

Regarding your personal data, you may apply to the Data Controller in accordance with Article 11 of the KVKK. You may submit your requests either via kvkk@starsoulapp.com or via a written application by post to the registered address of the Company. If you wish to use the form available on our website, please submit your request using the e‑mail address registered with your membership.

The Company reserves the right to update this Cookie Illumination Text at any time due to changes in applicable laws or regulations.

These Terms of Use (“Agreement”) are entered into by and between Starsoul Teknoloji Yazılım Bilişim A.Ş. (hereinafter “STARSOUL”), the owner of the website (www.starsoulapp.com) and the mobile application (STARSOUL – Birth Chart & Numerology Matching), and the person or entity (individual or legal) using the platform (hereinafter “USER”). By accessing the platform in any way or using the services offered by STARSOUL (including any paid services), the USER represents, accepts and undertakes that they are over the age of 18, have read and understood all provisions of these Terms of Use, and accept all the clauses herein. The contract between STARSOUL and the USER qualifies as a distance sales contract, and any amendments made by STARSOUL now or in the future will be deemed to have been tracked and accepted by the USER via the internet.

In accordance with Law No. 5651 on the Regulation of Publications on the Internet and Combating Crimes Committed Through These Publications, STARSOUL acts as a content provider and is considered as the real or legal person producing, organizing and providing all kinds of information, data and content presented to users online. As a content provider, STARSOUL is responsible for all content on the platform for which it holds the copyright.

STARSOUL reserves the right to suspend content and accounts that involve or are suspected of involving criminal activity, and does not permit content for which an access‑blocking decision has been made. Such blocked offences under Law No. 5237 of 26/9/2004 include: directing someone to commit suicide (Article 84), sexual abuse of children (Article 103, first paragraph), encouraging use of narcotic or stimulant substances (Article 190), providing substances harmful to health (Article 194), obscenity (Article 226), prostitution (Article 227), and providing venues or opportunities for gambling (Article 228). STARSOUL strictly prohibits the presence of such content on the platform and will act immediately upon detection or notification. 

The astrological and matching interpretations on STARSOUL are provided strictly for entertainment purposes. The USER acknowledges that these interpretations cannot influence or direct their future life, personal decisions, choices or preferences in any way. All commentary, chats and responses available on STARSOUL should not be taken seriously nor used as guidance for daily life. The platform is not intended for those under 18, persons with restricted legal capacity, persons with intellectual disabilities, persons with severe psychiatric disorders or persons who may not comprehend the service due to health reasons; such use is inadvisable. STARSOUL is suitable for adults 18 years or older with sound mind; STARSOUL accepts no liability for external use.

No content on the STARSOUL platform – including software source code and all components –may be altered, copied, used or legally modified without prior written permission, even if attributed. STARSOUL accepts the accuracy of personal or corporate data submitted by USERS under the distance sales contract regime but does not bear any responsibility for verifying such data. Once personal or corporate information is declared, the person or entity is deemed to be the one declaringsaid data. STARSOUL is obliged to provide requested information, documents and data to competent judicial or administrative authorities.

All content is protected by Law No. 5846 on Intellectual and Artistic Works and Law No. 6769 on Industrial Property. All trademarks, patents or registered or pending design elements appearing in the content may not be used by third parties without prior written consent.

In the event of technical attacks or force‑majeure situations, STARSOUL shall not be held liable if support provided is insufficient and user information is compromised.

General legal rules, case law, public morality and local custom and practice apply. STARSOUL reserves the right to take necessary action for USER’s non‑compliant behaviour. In such cases, STARSOUL may recourse the USER for any additional costs incurred.

Any and all responsibility stemming from interpersonal or social relationships formed through or because of STARSOUL – and commercial relationships established through or due to STARSOUL membership – lies solely with the relevant USERS, and not STARSOUL. STARSOUL may refuse service to any USER at its sole discretion without reason. STARSOUL may use all collected data for statistical analysis, performance evaluation, business operations and improvement; this use is deemed equivalent to explicit consent given at the time of STARSOUL registration and is compliant with applicable law.

Confidential Information and Personal Data

Pursuant to Article 10 of Law No. 6698 on the Protection of Personal Data (KVKK), STARSOUL operates as the data controller and processes personal data in accordance with the said law within the scope of its entertainment‑oriented services. The types of personal data processed include: Account Data, Profile Data, Content, Purchase Data, Marketing, Survey and Research Data, Third‑Party Data, Customer Support Data, Social Media Data, Usage Data, Technical Data, Geolocation Data, Facial Geometry Data.

Purpose of Processing Personal Data

In order for you to use STARSOUL effectively and build meaningful connections, it is necessary for you to provide certain basic profile details and other information, such as the type of person you wish to meet. Failure to provide such data may limit your access to the key functionality of our service. Additionally, usage data—such as your login times and usage habits—are automatically collected. If you sign in via another platform (e.g., Facebook, Google or Apple) or transfer data from such an account, we may also obtain information from those providers.

Collected personal data may be processed for the following purposes:

• To create and maintain your account and profile

• To operate and maintain various features of the service

• To recommend other members and present you to them

• To conduct prize draws and contests

• To respond to your requests and inquiries

• To monitor the proper functioning of the service and address or correct problems

Personal data may be transferred to domestic or international direct or indirect business partners, solution providers, and authorized public authorities.

Personal data will be retained for at least ten (10) years. After this period, data may continue to be processed if required; otherwise, it will be immediately erased, destroyed or anonymised.

STARSOUL has adopted necessary technical and administrative measures to prevent unlawful processing, unauthorised access and to safeguard your personal data.

Our Company processes your personal data in compliance with the Law No. 6698 on the Protection of Personal Data (“KVKK”) and the relevant secondary legislation. “Personal data” refers to any information that identifies or makes your identity identifiable. We would like to inform you about the processing of your personal data in the event that you accept the Membership Agreement and become a “Platform Member” in order to benefit from the services (“Platform Services”) offered through our mobile applications and/or websites (“Platform”).

2 – Which Personal Data Do We Process?

When you become a Platform Member, the following categories of personal data are processed: 

User Account Information: your name, surname, customer number, membership e-mail address, and if provided, your phone number, gender, date of birth, and place of birth; identity and contact information (name, surname, e-mail address, phone number); username and profile information; application usage information and preferences.Customer Transaction Information: order and invoice details, transaction history of your purchases, requests and complaints, Platform usage data, comments and/or questions you submit regarding products, information shared within such content, rating and review information, chat records, and cancellation/return details.

Payment Information: details regarding payments and payment methods, stored card information.

Transaction Security Information: device information, IP address, password and login credentials, cookie information, Platform access logs, login methods (Google / Facebook).

Legal Transaction Information: correspondence with competent authorities, information within lawsuits or enforcement files, and official information requests.

Audio Recordings: voice recordings from calls made with our call center.

Additional Service Information: data processed when you use supplementary services offered through the Platform.

Shared with payment institutions, banks, invoicing partners, and SMS/e-mail service providers for

4.3 Customer Experience Improvement

Shared with customer-support partners, call-center providers, IT / software / analytics service providers, and consultants (including those located abroad).

4.4 Information Security, Risk, Audit, and Control

Shared with auditors, accountants, tax advisors, independent consultants, banks, e-invoice integrators, and potential transaction parties in case of structural corporate changes.

Legal Grounds: legal obligations; contract necessity; legitimate interests of the Company.

4.5 Legal Transactions

Shared with regulatory and supervisory authorities, courts, enforcement offices, mediators, lawyers, auditors, and forensic or cyber-security experts, as well as competent authorities abroad when required.

Legal Grounds: explicit legal provisions; fulfillment of legal obligations; establishment, exercise, or protection of a right; exceptional circumstances under Article 9/6 of KVKK.

4.6 Processing Based on Explicit Consent

Shared with affiliates, group companies, and business partners for marketing, promotion, and personalized offer activities.

5 – How Does the Company Protect Your Personal Data?

Personal data shared with our Company remain under the supervision and control of Starsoul Teknoloji Yazılım Bilişim A.Ş.

We undertake to establish the necessary organization and technical measures to ensure data confidentiality and integrity in compliance with applicable legislation. In this context:
